BIOLABS PEPTIDES – TERMS OF SERVICE (SOUTH AFRICA)

These Terms of Service (“Terms”) govern your access to and use of the BIOLABS PEPTIDES website and any purchases made through it (the “Website”). By using the Website or placing an order, you agree to be bound by these Terms.
If you do not agree, do not use the Website.
1) About BIOLABS PEPTIDES
BIOLABS PEPTIDES (“we”, “us”, “our”) provides peptide-related products and research compounds for supply within South Africa.
Important: Products sold on this Website are supplied for laboratory/research purposes only and are not sold as medicines and are not intended for human or animal consumption.
2) Eligibility
You may use this Website and place orders only if:

You are 18 years or older and have legal capacity to contract; and

You will comply with these Terms and all applicable South African laws.
We may request proof of age and/or identity and may refuse service where we reasonably suspect misuse or unlawful intent.
3) Research-use-only disclaimer (no medical use)
3.1 No medical advice. Nothing on this Website constitutes medical advice, diagnosis, treatment guidance, dosing instructions, or a recommendation to use any product in or on the human body.
3.2 Research use only. All products are supplied on a strict “For Research Use Only – Not for Human Consumption” basis. You agree not to use, represent, market, or rely on the products as medicines or for therapeutic outcomes.
3.3 Regulatory context. South African law regulates the sale, marketing, and supply of medicines and substances intended to diagnose, treat, or modify bodily function, and generally requires appropriate registration/authorisation where applicable. You agree not to use our Website or products in a way that would contravene such laws or trigger unlawful supply.
4) Product information, COAs, and accuracy
4.1 We aim to describe products accurately. However, product images, packaging, and lab documentation may change without notice.
4.2 Where available, we may provide batch-specific documentation (e.g., COA). Availability of testing documentation does not convert products into medicines and is provided for research transparency only.
4.3 We reserve the right to correct pricing errors, stock errors, description errors, or technical issues at any time.
5) E-commerce disclosures (ECTA)
We provide information required for online transactions, including product descriptions, pricing, delivery arrangements, and contact channels, in accordance with South African e-commerce requirements.
6) Orders and acceptance
6.1 Placing an item in a cart does not reserve stock.
6.2 An order is an offer to buy. We may accept or reject any order in our discretion, including where:

payment is not received/verified,
-
we suspect fraud, unlawful intent, resale, or policy breaches,
-
stock is unavailable, or
-
courier delivery is not feasible.
6.3 If we cancel an order after payment, we will refund the amount paid for that cancelled item/order (subject to clause 10 on returns/refunds where relevant).
7) Pricing, VAT, and payment
7.1 Prices are shown in ZAR. VAT will be handled as required by law (where applicable).
7.2 Payment methods may include EFT and card payments (where enabled). Orders may only ship once payment has cleared/confirmed.
7.3 We may use payment screening and anti-fraud checks. If a payment is reversed or charged back, we may suspend your account and recover associated costs.
8) Shipping and delivery (South Africa)
8.1 We deliver within South Africa using third-party couriers. Delivery timeframes are estimates and may vary by area, public holidays, and courier capacity.
8.2 Risk of loss passes to you on delivery to the address you provide. You are responsible for ensuring the delivery details are correct.
8.3 If you provide an incorrect address or fail to receive delivery, you may be responsible for additional courier costs.
8.4 If delivery becomes impossible for reasons beyond our control (e.g., courier network disruption), we will work with you to find an alternative solution. If we must cancel, we will refund the amount paid for undelivered goods.
9) Storage and handling responsibility
You acknowledge that peptides/research compounds may be sensitive to temperature, light, and handling. Once delivered, correct storage and handling are your responsibility. We are not liable for degradation caused by mishandling, improper storage, or exposure after delivery.
10) Returns, refunds, and cancellations (CPA/ECTA aligned)
We comply with the South African Consumer Protection Act (“CPA”) and applicable e-commerce rules. Consumer rights under the CPA cannot be excluded by contract.
10.1 No returns for misuse / opened sterile goods
For safety, contamination, and integrity reasons, we may refuse returns of products that are opened, tampered with, or not in resalable condition—especially where sterile packaging integrity is compromised—unless the return is required by law (e.g., defective/incorrect item).
10.2 Defective / wrong item
If you received the wrong item or a defective item, notify us within a reasonable time with photos and order details. Where confirmed, we will arrange a replacement or refund as required by law.
10.3 Cooling-off / cancellation rights
Certain cooling-off rights may apply in limited circumstances (e.g., direct marketing transactions), as regulated by the CPA. If a statutory cooling-off right applies to your purchase, we will honour it.
10.4 Order cancellations before dispatch
If you request cancellation before dispatch, we may approve it. Approved cancellations may be subject to reasonable administrative or payment processing costs where permitted by law.
11) Prohibited conduct
You may not:

use the Website or products for unlawful purposes;

resell products as medicines, supplements, or therapies;

publish or request dosing/injection instructions through our Website channels;

attempt to bypass security, scrape data, or interfere with site operation;

make false claims, impersonate others, or commit fraud.
We may suspend or terminate access and/or refuse service where we suspect prohibited conduct.
12) Limitation of liability
12.1 Use of this Website and products is at your own risk.
12.2 To the maximum extent permitted by law, we are not liable for indirect, consequential, or special damages, loss of profit, or reputational harm arising from your use of the Website or products.
12.3 Nothing in these Terms limits liability that cannot legally be limited under South African law.
13) Indemnity
You indemnify BIOLABS PEPTIDES, its directors, staff, and service providers against any claim, loss, damage, investigation, or legal expense arising from your misuse of the Website or products, including any unlawful use, unlawful resale, or misrepresentation of products as medicines.
14) Intellectual property
All content on the Website (text, design, logos, images) is owned by or licensed to BIOLABS PEPTIDES. You may not copy, reproduce, or distribute it without written permission.
15) Privacy and POPIA
We process personal information in line with South African data protection requirements under POPIA, including lawful processing, purpose limitation, security safeguards, and data subject rights.

16) Changes to these Terms

17) Governing law and jurisdiction
These Terms are governed by the laws of the Republic of South Africa. You consent to the jurisdiction of the courts of South Africa for disputes arising from these Terms.
